<span style="font-style: italic;">TheStreet.com's Jim Cramer says it looks like the patent worries aren't so dire after all. </span><br /><br />  Now that we see that health care reform is not going to bring price caps or socialization of medicine, we are beginning to see some real expansion in the drug stocks, including Merck (<a href="http://finance.aol.com/quotes/merck-and-co-inc-new/mrk/nys">MRK</a>) (<a target="blank" href="http://find.thestreet.com/cgi-bin/texis/cramertake_free?site=tsc&amp;puc=aoljjc&amp;tkr=MRK">Cramer's Take</a>), Bristol-Myers (<a href="http://finance.aol.com/quotes/bristol-myers-squibb-company/bmy/nys">BMY</a>) (<a target="blank" href="http://find.thestreet.com/cgi-bin/texis/cramertake_free?site=tsc&amp;puc=aoljjc&amp;tkr=BMY">Cramer's Take</a>) and Lilly (<a href="http://finance.aol.com/quotes/eli-lilly-and-company/lly/nys">LLY</a>) (<a target="blank" href="http://find.thestreet.com/cgi-bin/texis/cramertake_free?site=tsc&amp;puc=aoljjc&amp;tkr=LLY">Cramer's Take</a>). But there is one drug stock that is continually met with skepticism -- Sanofi Aventis (<a href="http://SNY">SNY</a>) (<a target="blank" href="http://find.thestreet.com/cgi-bin/texis/cramertake_free?site=tsc&amp;puc=aoljjc&amp;tkr=SNY">Cramer's Take</a>), the French vaccine and pharmaceutical maker run by Christian Viehbacher. The resistance is obvious, as his biggest two drugs are coming off patent very soon, and his hope is that by 2013 the company might again reach 2008 levels.  <br /><br />  Sounds like there's no reason to buy this one. The pharmaceutical firm earned 43 cents per share, or  51 cents per share in adjusted earnings. A year ago, PFE earned 34 cents per share before item exclusions. The Street expected PFE to report third-quarter earnings of 48 cents per share excluding items. <br /><br />Quarterly revenue checked in at $11.62 billion,  3% lower than last year's third-quarter revenue. The September unemployment rate rose to 9.8%, exactly what most observers had been expecting.<br /><br />T<font color="#000000"><font face="Arial,Verdana,Sans-Serif">h</font></font>e markets tried to gain back more than all the early losses, with all three major indexes ending slightly down. Crude oil has fallen below $70/barrel again, and gold has broken through $1,000/oz again. It could just be the case that the nearly 60% run-up since March in the S&amp;P 500 was just wishful thinking that the economy was turning around and that consumer spending would would tick up as things improved. That thinking has not been borne out yet, so markets are likely to wobble around until the consumer decides what to do -- save or spend. The holiday season could write the ending to the story.

The reason for the changes are that <a href="http://finance.aol.com/quotes/wyeth/wye/nys/option-chains">Wyeth </a>(NYSE: <a href="http://finance.aol.com/quotes/wyeth/wye/nys/option-chains">WYE</a>) is being acquired by <a href="http://finance.aol.com/quotes/pfizer-inc/pfe/nys/option-chains">Pfizer<strong> </strong></a>(NYSE: <a href="http://finance.aol.com/quotes/pfizer-inc/pfe/nys/option-chains">PFE</a>), leaving an opening in both the S&amp;P 100 and S&amp;P 500 (SPX). I want to focus on the stock that will <a href="http://www.rttnews.com/ArticleView.aspx?Id=1083253&amp;Category=Breaking%20News">replace WYE</a> in the SPX, <a href="http://finance.aol.com/quotes/first-solar-inc/fslr/nas">First Solar</a> (NASDAQ: <a href="http://finance.aol.com/quotes/first-solar-inc/fslr/nas">FSLR</a>). In after-hours trading, FSLR jumped more than 6% in response to the announcement.<br /><br />FSLR manufactures solar modules and is a major benefactor of what I like to call the "green rush" that took place during the past two years. FSLR capitalized nicely on the global environmental consciousness revolution last year, ascending as high as the $310 region. The company posted earnings of 44 cents per share versus analyst estimates of 39 cents. PFE October option implied volatility is at 26, December is at 31; below its 26-week average of 36, according to Track Data, suggesting decreasing price movement.</p>

<span style="font-style: italic;">TheStreet.com's Jim Cramer says health care has never been this cheap relative to the market in its history.  </span><br /><br />  Health care's not done rallying. As President Obama prepared himself for claiming a great political victory, we are all recognizing that the single-payer, socialized medicine covering cradle-to-grave, 100% paid for by the rich, the fear that left all things health care in the P/E dustbin, is dead. That's not going to happen.  <br /><br />  That leaves us with the biggest bargains the market has to offer. <br /><br />   Health care has never been this lowly valued relative to the market in its history. Remember, 98% of the time it trades at a meaningful premium. I think that many believe some of these moves (like the <a href="http://finance.aol.com/quotes/celgene-corporation/celg/nas">Celgene</a> (NASDAQ: <a href="http://finance.aol.com/quotes/celgene-corporation/celg/nas">CELG</a>) (<a target="blank" href="http://find.thestreet.com/cgi-bin/texis/cramertake_free?site=tsc&amp;puc=aoljjc&amp;tkr=CELG">Cramer's Take</a>) move) is because of gigantic new drug finds. Quite frankly, I found them to be boring. Of course, maybe boring isn't too bad these days, right? It's a lot better than an exciting ride on a profit-decline express.</p>
<p>Well, actually, Merck <em>did</em> see a decline in its bottom-line profit, but it wasn't an outrageously awful drop or anything like that. Merck made an adjusted 83 cents per share compared to an adjusted 86 cents per share in the comparable period. Three less pennies isn't the worst thing in the world on a relative basis. JNJ is expected to post a bit of a profit decline. Last year's Q2, according to <a href="http://www.earnings.com/company.asp?client=cb&amp;ticker=jnj">Earnings.com</a>, saw the health-care business earn $1.18 per share. This time around, analysts are thinking that JNJ will do somewhere around $1.11 per share.</p>
<p>Will JNJ beat the analysts? It's quite possible, since the company has a good record on this count. As a matter of fact, JNJ beat predictions by four cents <a href="http://www.bloggingstocks.com/2009/04/14/johnson-and-johnson-jnj-posts-better-than-expected-earnings/">back in April</a>. Sales, however, came in a little weak. Interestingly enough, <a href="http://finance.aol.com/quotes/johnson-and-johns-dc/jnj/nys">the market </a>didn't really care too much about the earnings performance on that day. Shares had rallied a bit in pre-market trading, but they closed slightly down by the end of the regular session. I found a similar situation <a href="http://www.bloggingstocks.com/2009/01/21/johnson-and-johnson-solid-quarter-but-could-there-be-more-downsi/">back in January</a>. </p>

The drug is for treating colorectal cancer, and the study was terminated because it failed to achieve its primary end point in the study. An independent committee (the Data Monitoring Committee) found that adding sunitinib to the chemotherapy regimen FOLFIRI would be unable to demonstrate "a statistically significant improvement in the primary endpoint of progression-free survival compared to FOLFIRI alone."</p>

Data from Thomson Reuters reports a 29% increase in capital markets and M&amp;A fees for the first time in more than a year. Share sales (e.g., rights offerings) were where dealmakers found the action. In the shrinking M&amp;A space, <a href="http://finance.aol.com/quotes/morgan-stanley/ms/nys" target="_blank">Morgan Stanley</a> (NYSE: <a href="http://finance.aol.com/quotes/morgan-stanley/ms/nys" target="_blank">MS</a>) has taken the lead spot. </p>
<p>Since there are fewer banks in the marketplace than there were a year ago -- and they have less money -- the capital is starting to come from elsewhere. And, the latest deal hit the markets today: <a href="http://finance.aol.com/quotes/mdso/nas">Medidata</a> (NASDAQ: <a href="http://finance.aol.com/quotes/mdso/nas">MDSO</a>).<br /><br />So far, the shares are up 19% $16.70 (the IPO priced at $14, which was above its $11-$13 price range).</p>
<p>Founded about ten years ago, Medidata develops web-based software for clinical trials management. Obviously, it's a big market opportunity. <br /><br />Keep in mind that a drug costs more than $1 billion to develop. Oh, and the process can easily go beyond a decade.
